All guided activities are operated by Adventure Tours Scotland (ATS) and by booking you agree to these Terms & Conditions. All guided activities you book with Adventure Tours Scotland are organised and sold subject to the following conditions:

FINAL PAYMENT & ACCEPTANCE OF BOOKING

When booking a guided activity, we require a 25% non-refundable deposit to secure your activity on a chosen date. The full balance is due 14 days prior to your chosen activity date.

The confirmation sent by Adventure Tours Scotland will contain details of final payment required for any booking. Payment of the balance of the price for any products or services booked is due 14 days before the booked activity date. If full payment is not received by the applicable due date, Adventure Tours Scotland, at its sole discretion, may treat the booking as cancelled and retain the deposit paid on booking as a cancellation fee. If a booking is made less than 14 days before the activity date then the full amount must be paid at the time of booking. If, for any product or service booked, payment terms differ from those outlined in this section, the applicable terms will be communicated to you prior to booking and will also be detailed on the applicable invoice.

Adventure Tours Scotland is not responsible for any charges levied by third parties or financial institutions and payable by you as a result of credit card or other payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to Adventure Tours Scotland.

CANCELLATION BY THE PARTICIPANT

You may cancel your booking by notifying Adventure Tours Scotland in writing and by the person who made the booking. Cancellation fees, will be determined with reference to the date on which notice of cancellation is received by Adventure Tours Scotland and are expressed as a percentage of the total price paid for the cancelled activity, product or service.

If a balance is remaining on a booked activity within the 14-day deadline of the first day of an activity then Adventure Tours Scotland reserves the right to cancel the tour and retain the deposit plus a £50 Admin Fee .

Cancellation 14 days or more before the tour date: you will receive a full refund less the non-refundable 25% deposit already paid plus a £50 Admin Fee.

Cancellation 14 days or less before the booked and confirmed activity: No refund will be payable in respect of any cancelled activity.

On request Adventure Tours Scotland may offer the opportunity to transfer the date of tour where possible but transferring tour dates is not guaranteed and is dependent on the availability of our vehicles and guides.

Where exceptional circumstances so warrant, the management of Adventure Tours Scotland reserves the right (in its absolute discretion) to cancel tours or services. In such cases clients will be promptly informed and offered a full refund.

Age Requirements

Anyone under the age of 18 is considered to be a minor. Minors must always be accompanied by an adult. One adult may accompany up to two minors.

The minimum age for minors participating in a guided activity is 12 years old.

All bookings with a minor are subject to review and approval by Adventure Tours Scotland.

Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behaviour, wellbeing, supervision and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. Adventure Tours Scotland does not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s).

ADVENTURE ACTIVITIES & CLIENT RESPONSIBILITY

It is a fundamental booking condition that you accept the hazards involved in this sort of trip and you accept that in visiting remote and mountainous regions there is an element of flexibility. Your activity confirmation is indicative only and not a guarantee that a particular route will be followed or place reached. You must acknowledge that delays and alterations and their results, such as inconvenience and discomfort, are possible where unforeseen circumstances arise. You must have a level of fitness commensurate with your chosen activity and you are responsible for bringing the appropriate equipment, details of which will be sent to you at the time of booking. If in the opinion of the Adventure Tours Scotland Guide or Staff, your health, conduct, fitness or equipment may compromise the safety of a trip, or if it could negatively impact the experience of other clients on the trip, we reserve the right to cancel or terminate your activity. In these circumstances, you will not be entitled to a refund nor compensation.

RISKS AND INSURANCE

Adventure Tours Scotland are not responsible for any accidents or injury which may occur at any of the sites we visit or during any of our arranged activities. Each location we visit have a duty of care for your enjoyment of experience, comfort and safety. Clients must have appropriate and adequate insurance with a reputable insurer to cover death, personal injury, medical expenses, repatriation expenses, loss of or damage to luggage and contents of same and expenses associated with cancellation or curtailment of a guided activity. Each client is responsible for loss of or damage to baggage or personal possessions or consequential loss arising there from. In the event of client illness, then the relevant client must accept responsibility for any medical costs incurred and Adventure Tours Scotland shall not be liable to refund any part of the tour cost. It is incumbent on each client to ensure that insurance cover held is both current and adequate for the particular needs of such client and/or group for which such client is responsible. All visitors from overseas must have insurance to cover accident and repatriation.

COMPLAINTS PROCEDURE

Whenever possible, clients (customers) should promptly bring a complaint to attention of the Guide or Company. 
Clients wishing to lodge a complaint after an activity should write to the Company within 28 days of the booked activity providing full details. The Company will endeavor to resolve such complaint in an amicable manner as expeditiously as possible

HEALTH & SAFETY

The group must at all times abide by the directions of the Activity Guide.

Adventure Tours Scotland must be notified in advance of clients which are suffering from any medical condition or are taking medication which is likely to interfere with their mobility and/or ability to fully participate in the agreed tour program.

Clients whose fitness level or medical condition is not considered by Adventure Tours Scotland or Guide to be appropriate for certain activities may be asked to make alternative arrangements. In such cases compensation will not be offered by the Company.

Clients should be aware that weather conditions in Scotland can be severe and hence MUST be properly equipped.

Adventure Tours Scotland reserves the right to terminate an activity if, in the reasonable opinion of the Company the behaviour of a client or client group is or is likely to be disruptive, dangerous or upsetting to other people or if such client or group have caused or are likely to cause damage to property. Adventure Tours Scotland will not pay any refund or costs incurred by a client in the event that a tour is terminated due to unacceptable behaviour.

GUIDED ACTIVITY POLICY

We provide a private guided activity service which is exclusive to your group only. We do not add other groups to your tour, nor do we accept bookings for individuals joining together to make up numbers. Our guided activities are not designed for split groups and your booking may be cancelled if we suspect this is the case.
